1. Acceptance of Terms

By downloading, accessing, or using the BettinGPT mobile application (the "App") or visiting our website at bettingpt.com (the "Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or Website.

2. Eligibility

  • You must be at least 18 years of age to use BettinGPT.
  • You must be legally permitted to access sports betting analysis content in your jurisdiction.
  • You represent that all information you provide is accurate and complete.
  • You are solely responsible for ensuring compliance with all applicable local, state, and federal laws regarding sports betting in your jurisdiction.

3. Description of Service

BettinGPT provides AI-powered sports betting analysis and informational content. The App allows users to ask questions about games, odds, player statistics, and receive AI-generated analysis.

IMPORTANT GAMBLING DISCLAIMER: BettinGPT is NOT a sportsbook, gambling platform, or betting service. We do not:

  • Accept bets or wagers of any kind
  • Process deposits, withdrawals, or any financial transactions related to gambling
  • Facilitate, broker, or intermediate gambling activities
  • Guarantee the accuracy, completeness, or profitability of any analysis

We provide analysis and informational content only. Past performance of any analysis does not indicate future results.

4. Account Terms

  • You may create one account per person.
  • You are responsible for maintaining the security of your account credentials.
  • You must not share your account with others or allow unauthorized access.
  • You must notify us immediately of any unauthorized use of your account.
  • We may suspend or terminate accounts that violate these Terms.

5. Subscription and Billing

BettinGPT offers the following subscription tiers:

  • Free: $0.00 — 5 AI analysis queries, no payment required.
  • Pro: $7.99 per week — 100 queries per billing period.
  • Premium: $24.99 per month — 500 queries per billing period.

Important billing terms:

  • All payments are processed through the Apple App Store or Google Play Store.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can cancel your subscription at any time through your device's App Store or Google Play settings.
  • Refunds are subject to Apple's or Google's respective refund policies.
  • We reserve the right to change pricing with reasonable advance notice.
  • Unused queries do not roll over between billing periods.

6. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble the App
  • Use automated tools, bots, scrapers, or scripts to access the App
  • Attempt to circumvent query limits or subscription restrictions
  • Share, resell, or redistribute analysis content generated by the App
  • Use the App for any illegal purpose
  • Harass, abuse, or threaten other users or our staff
  • Interfere with or disrupt the App's infrastructure
  • Create multiple accounts to abuse free tier limits

7. Gambling Disclaimer

This section is critical. Please read carefully:

  • BettinGPT is for informational and entertainment purposes only.
  • We do not encourage, promote, or facilitate gambling.
  • All betting decisions are solely your responsibility.
  • You acknowledge that sports betting involves financial risk and you may lose money.
  • If you choose to place bets based on our analysis, you do so entirely at your own risk.
  • We are not responsible for any financial losses resulting from betting decisions made using our analysis.
  • No analysis, prediction, or recommendation provided by BettinGPT constitutes financial or gambling advice.
  • We strongly encourage responsible gambling practices.

8. Intellectual Property

  • All content, features, functionality, design, and branding of BettinGPT are owned by BettinGPT Inc. and are protected by copyright, trademark, and other intellectual property laws.
  • The BettinGPT name and logo are trademarks of BettinGPT Inc.
  • You may not copy, modify, distribute, or create derivative works from our content without written permission.
  • AI-generated analysis provided through the App is licensed to you for personal, non-commercial use only.

9. User Content

  • You retain ownership of the queries and messages you submit to the App.
  • By submitting queries, you grant us a license to process them for the purpose of providing the service.
  • We may use anonymized, aggregated query data to improve the service. This data cannot be traced back to you.

10. Third-Party Services

The App integrates with third-party services including Google Sign-In, Apple Sign-In, sports data providers, and AI model providers. We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of third-party services is governed by their respective terms and privacy policies.

11. Disclaimers

THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
  • WARRANTIES THAT ANY ANALYSIS OR PREDICTION WILL BE ACCURATE OR PROFITABLE
  • WARRANTIES REGARDING THE TIMELINESS OR ACCURACY OF ODDS AND STATISTICS DATA

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTINGPT INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data
  • Financial losses from betting decisions
  • Damages arising from service interruptions
  • Damages resulting from unauthorized access to your account

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless BettinGPT Inc., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your betting or gambling activities
  • Your violation of any third-party rights

14. Termination

  • We may suspend or terminate your account at any time for violation of these Terms, with or without notice.
  • You may delete your account at any time through the App (Profile > Delete Account) or by emailing support@bettingpt.com.
  • Upon termination, your right to use the App ceases immediately.
  • Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved as follows:

  • Informal Resolution: The parties will first attempt to resolve any dispute informally for a period of 30 days after written notice.
  • Arbitration: If informal resolution fails, disputes will be settled by binding arbitration in accordance with the rules of the American Arbitration Association.
  • Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the App or by email. Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
